THE MALAYSIAN HINDUS FUNDAMENTAL LIBERTIES DENIAL

RESTRICTION TO FREEDOM OF RELIGION

1. The so-called guidelines for Non-Muslim places of worship implemented by Selangor State Government via their agencies such as state local authorities which setting land size limitation of not more than 10,000 square feet for the use of Non-Muslim places of worship is ultra vires. 

2. The said guidelines has gone beyond the Article 11(3) of Federal Constitution which guarantees freedom of religion because it has exceeded the Constitution’s provision which promises the right of religious group to acquire property.\

3. By virtue of Article 4(1) of Federal Constitution; one should bear in mind that the Constitution is the supreme law of the Federation and any law passed after Merdeka Day which is inconsistent with this Constitution shall, to the extent of the inconsistency, be void. Furthermore guidelines is not and should not be the law of the Federation.

4. Although the Constitution theoretically guarantees religious freedom but in practice there are limitations, restrictions and other unfair conditions imposed on the religious minorities such as Hindus as stated above.
