THE LAW ON SUMMARY JUDGMENT

The law: A Summary Judgment (also judgment as a matter of law) is a Judgment entered by a Court for one party and against another party summarily without a full trial. Such a Judgment may be issued on the merits of an entire case, or on discrete issues in that case. The Summary Judgment is provided under Order 14 Rules of Court 2012.

Objective: To avoid the waste of unnecessary costs and time of the parties and Court for legal suits with facts and issues which are clear and straight forward.   

Who can file the application for Summary Judgment: Plaintiff in an action commenced by way of Writ Summons may apply to court for a Summary Judgment except for those actions stated under Order 14 rule 1(2)(a) and (b) Rules of Court 2012 which are:-

Order 14 rule 1(2)(a):-
Claims by the Plaintiff for libel, slander, malicious prosecution, false imprisonment, seduction or breach of promise of marriage.

Order 14 rule 1(2)(b):-
Claims by the Plaintiff based on an allegation of fraud.

The Grounds for Summary Judgment: That the Defendant has no defence to the Plaintiff’s claim or part of claim. In cases where the defence filed is a sham one and where there is really no triable issues that would require a full hearing.

Alternatively, the Plaintiff may apply to have the defence to be struck off on the grounds that it discloses no reasonable defence or that it is “scandalous, frivolous or vexatious” or that it may “prejudice, embarrass or delay the fair trial of the action” or that it is otherwise an abuse of the process of the court”.

When to file the Summary Judgment: The Summary Judgment must be filed when the defendant has enter the appearance.

The Notice of Application (Form 57) for Summary Judgment is to be supported by an Affidavit (Form 13) setting out clearly the claim, and it must be specifically stated that the defendant has no defence to the action, or that the defence filed is a sham case.

(a) Form 2 – Writ (High Court); or

(c) Form 11 – Memorandum of Appearance (Memorandum of Appearance in duplicate to be appended to Writ); and

Service of Writ by way of Personal Service or Prepaid A.R. Registered Post

CARA MEMOHON PENDAFTARAN PERSATUAN PENGANUT HINDU DENGAN JABATAN PENDAFTARAN PERTUBUHAN MALAYSIA (JPPM)

1.-Satu mesyuarat penubuhan yang dihadiri minimum 7 orang hendaklah diadakan dan nama mereka yang hadir hendaklah dicatatkan dalam minit mesyuarat penubuhan.

2.-Mesyuarat penubuhan hendaklah membuat ketetapan seperti berikut:

(a)-bersetuju menubuhkan pertubuhan;

(b)-meluluskan nama pertubuhan yang akan didaftarkan;
(nama pertubuhan hendaklah selaras dengan tujuan dan keahlian pertubuhan)

(c)-menetapkan alamat tempat urusan bagi pertubuhan yang akan didaftarkan;

(d)-melantik AJK Penaja Pertubuhan minimum 7 orang untuk menguruskan pendaftaran pertubuhan;

(e)- sediakan senarai AJK Penaja; dan

(f)-meluluskan undang-undang (perlembagaan) bagi pertubuhan yang hendak didaftarkan termasuk bendera, lambang dan lencana dengan keterangan (jika berkenaan);

3.-Senarai AJK Penaja hendaklah mengandungi butiran setiap AJK Penaja mengikut format yang ditetapkan oleh JPPM iaitu seperti berikut:

(a)-Jawatan dalam pertubuhan;

(b)-Nama penuh seperti dalam myKad;

(c)-Jantina;

(d)-Nombor kad pengenalan baru dan lama;

(e)-Warganegara;

(f)-Tarikh lahir dan Tempat lahir (daerah);

(g)-Pekerjaan;

(h)-Nama dan Alamat majikan;

(i)-Alamat kediaman semasa;

(j)-Nombor telefon (Rumah/Bimbit/Pejabat); dan

(d)-Emel;

4.-Setiap Ahli Jawatankuasa bagi Pertubuhan hendaklah dipastikan tidak hilang kelayakan memegang jawatan di bawah Seksyen 9A dan Seksyen 49 Akta Pertubuhan 1966.

5.-Minit Mesyuarat Penubuhan yang mencatatkan perjalanan mesyuarat penubuhan pertubuhan dan keputusan terhadap ketetapan-ketetapan yang dibuat hendaklah disediakan.

6.-Setiausaha Penaja hendaklah membuat pendaftaran pertubuhan secara online melalui sistem eROSES di www.eroses.gov.my.

7.-Bayaran Pendaftaran Pertubuhan sebanyak RM30.00 akan dikenakan bagi setiap permohonan yang dibuat.

8.-Pembayaran Fi boleh dibayar melalui kaunter JPPM atau secara online.

9.-Pertubuhan yang dibatalkan pendaftarannya selepas memperoleh kelulusan penubuhan mempunyai hak di sisi undang-undang seperti berikut:-

(a)-Membuat rayuan kepada Menteri Dalam Negeri dalam tempoh 30 hari dari tarikh perintah pembatalan; atau

(b)-Memfailkan Permohonan Semakan Kehakiman di Mahkamah Tinggi dalam tempoh 3 bulan dari tarikh perintah pembatalan.
